Alexander Linnikov took part in scheduled meeting of the Federal Council roundtable

Linnikov was invited by the Committee of the Council of the Federation on Constitutional law, Legal and Judicial Matters and Civil Society Development to take part in the roundtable meeting the main topic of which was «mediation procedures: the problems of legislative regulation and law enforcement practice and the ways of their solutions».
Regular session of roundtable meeting on the very interesting and urgent issue of «Mediation procedure: the problems of legislative regulation and law enforcement practice and their solutions» organized by the Committee of the Council of the Federation on Constitutional law, Legal and Judicial Matters and Civil Society Development took place in the Council of the Federation of the Federal Assembly of the Russian Federation on the 21st of March 2013.
During the session the reports of K.E. Dobrynin, the judge of the Highest Arbitration Court of the Federation, Ts. A. Shamlikashvili, the Presdent of National Organization of Mediators, Getman E.S., the judge of the Supreme Court of the Russian Federation, O.A. Ruzakova, Deputy Chief of the State Duma Committee Stuff on Civil, Criminal, Arbitration and Procedural Legislation. An informative discussion also took place between the participants of the roundtable — the representatives of academic community, community of judges, and practicing lawyers.
Productive exchange of the opinions between the participants of the discussion permits us to conclude that the following improvement of the legislation in the mediation area, organization of the theoretical foundation, and the citizen education on the usage and effectiveness of mediation in case of any conflicts will help the parties of the conflicts to use more actively the alternative procedure of conflict management with the participation of mediator (mediation procedure) and these actions will help the process of successful improvement of mediation.
Sharing impressions on the meeting A.S. Linnikov said that mediation is definitely important and necessary form of alternative conflict management which is focused not only on the conflict itself (the process of finding out who is right and who is wrong) or on the benefit, but on the positive search of the problem solution. Nevertheless, the legislation of this area requires considerable development and supplementation.
