Oleg Korshunov Case

Deputy Director of the Federal Penitentiary Service Oleg Korshunov is charged with a crime under clause 4 of art. 160 of the Criminal code of the Russian Federation (Appropriation and embezzlement). The law firm of «Linnikov and Partners» carries out Oleg Korshunov’s defense.
On September 14, 2017 Korshunov was arrested by the Basmanny District Court of Moscow until November 13, 2017. The defense strongly believes that the Resolution of the Court is unlawful and unfounded and intends to appeal it immediately. In the light of house arrest of ex-Minister Alexei Ulyukayev and famous director Kirill Serebrennikov, the taking of Oleg Korshunov into custody looks like an obvious attempt to put pressure on the accused, contrary to the current jurisprudence and elementary common sense.
As defense counsel at the hearing, Alexander Linnikov called for a cautionary measure not connected to imprisonment, suggesting house arrest as an alternative. In particular, the defender pointed out that the prosecution has not presented sufficient proof to justify the placement of Mr. Korshuov under a prison arrest. The only substantial motivation was the very gravity of the charges, which, according to the law and applicable jurisprudence, cannot be the only and unconditional grounds for taking an individual into custody. However, the Court disregarded medical data on the state of health of Mr. Korshunov and ignored information on his merits and multiple state awards and commendations, and unfairly sided with the prosecution. The Court’s position is a source of serious disappointment and concern.
