SESSION OF THE WORKING GROUP OF THE BUSINESS-OMBUDSMAN OF MOSCOW ON CRIMINAL PROCEDURE

On 27/02/2023 attorney Tatiana Tsepkina attended the ordinary session of the Working Group on Criminal Procedure hosted by the Public Commissioner for Protection of Rights of Entrepreneurs for the City of Moscow. Members of the Working Group discussed the draft amendments to the Code of Criminal Procedure that allow the extension of the period of preliminary detention pursuant to art. 91 and 92 of the CCP for the assessment of eligibility of an individual for bail, and reviewed the proposal for modifications to art. 107 of the CCP abolishing limitations on attendance of medical facilities by persons held under house arrest, as well as proposals for further humanization of rules of criminal procedure in respect of pregnant women and mothers of minors.

 

“L&P’s extensive criminal law practice shows that the current repressive approach to prosecution of individuals accused of economic crimes is unacceptable and must be urgently reversed, among other means, though decriminalization of certain offences in the sphere of business activity. The Working Group of the Business-Ombudsman of Moscow is a platform for productive dialogue between state authorities and the business community that helps to develop ways to improve current criminal laws and rules of procedure and formulate actual legislative initiatives”, – says Tatiana Tsepkina.
