ALEXEY SEREDA COMMENTS ON THE LATEST CONSTITUTIONAL COURT’S DECISION FOR THE “ADVOCATES’ GAZETTE”

On 15/03/2024 Alexey Sereda made a comment on the pages of the Advocates’ Gazette regarding the Decision of the Constitutional Court of the Russian Federation No. 243-O/2024 on the verification of the constitutionality of part 6 of Art. 71.1 of the Law on Education and paragraph 4 of clause 58 of the Regulations on targeted training of educational programs of secondary vocational and higher education. 6 of Article 71.1 of the Law on Education and subparagraph 4 of paragraph 58 of the Regulation on targeted training under educational programs of secondary vocational and higher education.

 

In his commentary, Alexei Sereda, an attorney of L&P, emphasized that the statutory obligation to pay a fine in case of early termination of the contract on targeted training does not limit the constitutional right to receive free education, and acts as a mechanism to compensate for the actual costs of training a citizen at the expense of the budget of the appropriate level in case of violation of contractual obligations on the part of the student.
